Terms of Service

By using the App, you agree to these Terms. If you do not agree, do not use the App.

Section 1

Description of Service

These terms govern the use of the ProMusica application operated by Wassermann Media s.r.o.

ProMusica enables you to:

  • browse and search for concerts,
  • create and manage concert information,
  • create user/artist profiles, follow artists, and save concerts,
  • share posts, photos, videos, and comments in the community section (Today's Activity),
  • read and search articles about classical music in the magazine (SvětHudby),
  • collect records of concert attendance through stamps in MyPassport,
  • earn points for concert attendance and activity within the App,
  • view the public listeners' leaderboard ranked by the number of stamps and points (filters: week, month, all-time),
  • take part in the weekly challenge (Challenge of the Week),
  • follow favorite artists and ensembles,
  • receive notifications.
Section 2

Age and Eligibility

The App is not intended for children under 13 years of age.

By creating an account, you confirm that you are at least 13 years old.

Section 3

Registration and Account

You agree to:

  • provide accurate and current information,
  • protect your login credentials,
  • be responsible for all activity under your account.

By creating an account and/or activating the MyPassport or Leaderboard features, you expressly consent (within the meaning of the GDPR) to the public display of your username and profile photo within the public listeners' leaderboard. You may withdraw this consent at any time by disabling the relevant option in the App Settings (see Section 9).

Section 4

Acceptable Use

You agree not to:

  • publish false or misleading information,
  • impersonate another person or organization,
  • infringe copyrights or other rights of third parties,
  • upload illegal or harmful content,
  • distribute spam or compromise security,
  • violate applicable laws.

4.1 Prohibition of Cheating in the Points and Stamps System

You agree that you will not:

  • falsify or fraudulently obtain concert attendance (e.g. by manipulating data, using automated tools, or submitting false confirmations),
  • buy, sell, or exchange points or stamps with other users,
  • share your account login credentials with a third party for the purpose of earning points under their name,
  • use hacking or other technical methods to obtain points or stamps outside the App's designated procedures,
  • create fake accounts for the purpose of multiplying points or stamps,
  • manipulate the timestamps of attendance or activities.

Warning: Violation of these rules may result in the immediate reset of points, removal of stamps, and temporary or permanent suspension of the account, with no right to compensation or restoration of awarded points.

Section 5

Community Guidelines

The community section is for sharing musical experiences and constructive discussion. Respect other users and maintain polite conduct.

The following is prohibited in the community section:

  • vulgar, offensive, or hateful language,
  • insults, personal attacks, or harassing content,
  • discrimination based on race, gender, religion, sexual orientation, or other characteristics,
  • spam, advertising, or unrelated content,
  • inappropriate or explicit content,
  • harassment or intimidation of other users,
  • misinformation or fake news.

Warning: Violation of community guidelines may result in immediate content removal, temporary or permanent suspension of access to the App.

Section 6

Today’s Activity (community feed)

Today’s Activity is the community section of the app (located within the Home tab) where registered users can share posts, photos, videos, comments, and reactions related to classical music.

6.1 Using Today’s Activity

  • Access to Today’s Activity requires a registered account in the ProMusica app.
  • Posts may contain text, photos, videos, and mentions (@mention) of other users.
  • Videos in posts may be up to 15 minutes long and must be in a supported format (MP4, WebM, MOV). Videos are converted into a suitable stream and optimized for mobile playback before being published.
  • Posts are publicly visible to all app users.
  • Users can react to posts with emoji reactions and comments.
  • Sharing concerts from the app into the Today’s Activity feed is permitted.

6.2 Video Content and Technical Requirements

Videos included in posts must meet the following conditions:

  • be related to classical music, concerts, or musical events,
  • contain no explicit, violent, sexual, or illegal content,
  • comply with all community guidelines (section 5),
  • be your own work or be published with the necessary permission.

The operator reserves the right to rotate, crop, transcode to a lower resolution, or remove videos for the purpose of server optimization.

Metadata and EXIF information contained in videos are removed before storage.

6.3 Restrictions and Prohibited Content

  • All community guidelines from section 5 apply to content in Today’s Activity.
  • Posts should be related to classical music, concerts, or musical events.
  • Commercial advertising or unrelated promotional materials are prohibited.
  • Photos and videos must be your own work or you must have permission to publish them.

6.4 Content Deletion and Moderation

  • You can delete your posts and comments at any time.
  • We reserve the right to delete any post, comment, photo, or video at any time without prior notice if it violates these Terms, community guidelines, or applicable law.
  • Repeated violations may lead to temporary or permanent account suspension.
  • App administrators are authorized to delete any content and manage reported content.

6.5 Data Storage

  • Posts, comments, and reactions are stored in Cloud Firestore database (EU region eur3).
  • Photos in posts are processed (resized, converted to WebP, EXIF data removed) and stored on CDN server cdn.promusica.cz in the Czech Republic.
  • Videos in posts are transcoded into an adaptive stream (HLS/MP4), stripped of metadata and EXIF information, scanned for prohibited and copyright-infringing content, and stored on CDN server cdn.promusica.cz in the Czech Republic.
  • Data is retained for the duration of your account, or until you manually delete it.
  • Upon account deletion, all posts, comments, reactions, photos, and videos are permanently removed within 30 days.

6.6 Reporting and Blocking

  • You can report inappropriate posts or comments directly in the app.
  • You can block users; once blocked, their posts will no longer be shown to you.
  • Blocking is mutual — the blocked user will not see your content either.
  • You can also report objectionable content at [email protected].
Section 7

SvětHudby (Magazine)

SvětHudby is the magazine section of the app featuring articles, reviews, interviews, and videos about classical music. Content is created by the ProMusica editorial team and approved contributors.

7.1 Using SvětHudby

  • Reading articles in SvětHudby is available to all app users without registration.
  • Articles can be searched by title, author, excerpt, and tags.
  • Articles can be filtered by category.
  • SvětHudby may contain video content (HLS/MP4 streams).

7.2 Content and Editorial

  • Articles are created through the admin interface at promusica.cz.
  • Only approved editors and administrators can publish articles.
  • Regular users cannot create or edit articles in SvětHudby.
  • Article content is protected by copyright. Copying, reproduction, or distribution without consent is prohibited.

7.3 Limitations and Liability

  • Articles in SvětHudby are informational and educational in nature.
  • The operator is not responsible for any inaccuracies in article content.
  • Opinions expressed in articles do not necessarily reflect the views of the operator.
  • We reserve the right to edit, update, or remove any article at any time without prior notice.

7.4 Data Storage

  • Articles are stored in Cloud Firestore database (EU region eur3).
  • Article images and videos are stored on CDN server cdn.promusica.cz in the Czech Republic.
  • Articles are retained indefinitely until removed by the editorial team or an administrator.
  • Article reading history and bookmarks are not stored per user.
Section 8

MyPassport, Stamps, Badges, and Points

8.1 MyPassport — Your Personal Music Collection

MyPassport is a personal profile that allows you to:

  • track attended concerts through stamps,
  • collect badges (achievements) for various musical activities,
  • earn points for attendance and activity within the App,
  • earn titles (e.g. "Classical Music Attendee", "Patron of the Arts") based on the number of stamps and points,
  • view a map of the cities and concert halls you have visited,
  • browse an overview of your most-heard composers and orchestras.

All data in MyPassport (stamps, points, badges, titles) is private by default. You may individually choose whether to share your MyPassport, or parts of it, with other users.

8.2 Stamps (Concert Attendance)

A stamp is a record of attendance at a concert. A stamp may be obtained by:

  • attending a concert registered in the ProMusica app,
  • verifying attendance via a QR code or another verification system provided by the organizer,
  • any other authorized method determined by the operator.

The operator reserves the right to:

  • verify the authenticity of a stamp and revoke it if fraudulent activity is detected,
  • reset or remove stamps from users who violate the App's rules,
  • adjust stamp counts in the event of a technical error or security incident.

Stamps have no monetary or material value, are not tradable, and ownership of them may be revoked at any time without any right to compensation.

8.3 Badges (Achievements)

Badges are symbols awarded automatically for reaching certain milestones or completing activities, for example:

  • composer milestone (attending a concert of a given composer X times),
  • venue milestone (attending a specific concert hall X times),
  • era badges (attending concerts of a given musical era),
  • orchestra badges (attending concerts of a given orchestra).

The list of badges and the criteria for awarding them are determined by the operator and may change without prior notice. Badges are awarded automatically and are not offered for sale or exchange.

The operator reserves the right to revoke any badge in the event of cheating.

8.4 Titles

Titles are dynamically assigned honorary statuses earned based on the total number of stamps and points. Examples of titles:

  • "Classical Music Attendee" — the basic title,
  • "Arts Benefactor" — for a higher number of stamps,
  • "Patron of the Arts" — for the highest milestones achieved.

The operator reserves the right to:

  • change the list of available titles,
  • change the criteria for awarding titles,
  • remove a title from a user if points or stamps have been misused.

Titles have no legal, financial, or material value.

8.5 Points System

Points are virtual units awarded for:

  • attending a concert (the number of points is determined by the operator, typically 1 point per concert),
  • activity in the Today’s Activity community (creating a post or a comment),
  • participation in the Challenge of the Week,
  • other activities determined by the operator.

Points:

  • have no monetary, financial, or material value,
  • cannot be bought, sold, exchanged, or transferred between accounts,
  • serve solely for the purpose of in-app ranking and your own overview,
  • may be cancelled, reset, or redistributed by an App administrator without prior notice and without any right to compensation.

The operator reserves the right to change the points system, the number of points awarded for individual activities, and the criteria for awarding them without prior notice.

8.6 Prohibition of Manipulation

Any attempt to cheat, manipulate, or gain unauthorized access to stamps, badges, titles, or points is strictly prohibited (see Section 4.1 for further detail). Violation automatically results in:

  • the reset of points and removal of stamps,
  • the cancellation of badges and titles,
  • temporary or permanent suspension of the account,
  • with no right to compensation, restoration, or reimbursement.
Section 9

Listeners’ Leaderboard

9.1 Public Ranking

The leaderboard is a public list of users ranked by their number of stamps and points. The leaderboard displays:

  • the username,
  • the profile photo (if set),
  • the number of stamps (concert attendances),
  • the number of points,
  • the current title (if the user has one).

By default, your username, profile photo, points, and stamps are visible to all other users on the public leaderboard. This information is shown automatically once you participate in the points system.

The leaderboard supports filtering:

  • by period: last week, last month, all-time ranking,
  • by category (e.g. by composer, hall, or orchestra — where implemented).

9.2 GDPR and Consent to Public Display

By creating an account and/or activating the MyPassport or Leaderboard features, you consent to the public display of your username and profile photo within the Leaderboard. If you do not wish to appear on the Leaderboard, you may disable this feature in the App Settings (the "Hide me from the leaderboard" option or similar).

The operator reserves the right to change the rules of public display at any time and will inform you of any such change.

9.3 Cheating and Manipulation

Users suspected of manipulating their ranking (purchasing points, faking attendances, account hacking, etc.) may be:

  • reset on the Leaderboard,
  • temporarily or permanently blocked from accessing the Leaderboard,
  • temporarily or permanently blocked from the entire App.

The operator reserves the right to audit the points and stamps of any user without prior notice.

9.4 Liability

The operator is not responsible for errors in the ranking caused by technical failures, algorithm changes, or other automated processes. The ranking may change in real time throughout the day and is not guaranteed to remain stable.

Section 10

Challenge of the Week

10.1 Description

The Challenge of the Week is a voluntary weekly activity that proposes a musical goal to users (e.g. "Attend a concert of composer X", "Listen to 5 works by orchestra Y", etc.).

Participation in the Challenge of the Week is entirely voluntary and is not required.

10.2 Points and Rewards

Completing the Challenge of the Week may grant bonus points or a badge, as specified in the description of the current Challenge. Points are awarded automatically upon meeting the conditions.

The Challenge of the Week does not involve any material prizes or money.

10.3 Changes

The operator reserves the right to change the Challenge of the Week, its completion criteria, the number of points, and the conditions without prior notice.

Section 11

Following Artists and Ensembles

11.1 Feature

Users may follow their favorite artists, orchestras, choirs, and ensembles. Following allows you to:

  • receive notifications about new concerts of the followed artist/ensemble,
  • see an overview of activities and news from the followed artist/ensemble,
  • access the profile of the followed artist/ensemble more quickly.

11.2 Privacy

The list of artists you follow is private by default. Other users cannot see it without your permission.

Artists and App administrators have access to aggregate, anonymized data on the number of followers, but not to lists of individual followers.

11.3 Prohibition of Misuse

You agree that you will not:

  • mass-follow accounts (bot behavior),
  • use following for spam or harassment,
  • create fake accounts for the purpose of inflating follower counts,
  • manipulate following data.

Violation of these rules results in temporary or permanent suspension of the account.

11.4 Deletion and Data

Following data is retained for the duration of the account. Upon account deletion, all following data is removed. Artists do not retain the personal data of individual followers.

Section 12

User Content

You are responsible for the content you upload (posts, comments, photos, concerts).

By uploading content, you represent that:

  • you are the author or have the necessary permissions,
  • the content does not infringe third-party rights,
  • the content complies with these Terms and community guidelines.
Section 13

Content Moderation

We reserve the right to:

  • moderate, edit, or remove any user content without prior notice,
  • delete posts or comments that violate community guidelines,
  • temporarily or permanently restrict access for users who repeatedly violate the rules,
  • block users without compensation.

You can report objectionable content directly in the App or at [email protected].

Section 14

License to User Content

By uploading content (posts, photos, videos), you grant a non-exclusive, royalty-free, worldwide license to use the content for operating ProMusica.

The license includes the right to:

  • display the content in the App and on the website,
  • back up and archive the content for security and compliance purposes,
  • convert the content into a suitable format for mobile playback (e.g. WebP for photos, an MP4/HLS stream for videos),
  • remove metadata (EXIF) and optimize the content for the server.

The license does not include the right to:

  • sell the content without your express consent,
  • claim authorship of the content,
  • use the content outside of ProMusica without your permission.

The license terminates upon deletion of the content or account. Details in the Privacy Policy.

Note: Stamps, points, badges, titles, and other data from MyPassport are not subject to this license. Such data remains the exclusive property of the App and does not constitute your intellectual property; it is merely a record of your activities within the App.

Section 15

Copyright

By uploading content, you represent that you are the author or have the necessary permissions. You may not upload copyrighted content without the rights holder's consent.

Section 16

Intellectual Property

The App and its content (including articles in the SvětHudby section) are protected by copyright. Without written consent, you may not copy, modify, or distribute the App or its content.

Section 17

Third-Party Concerts

ProMusica is not a concert organizer and does not sell tickets.

We are not responsible for program changes, concert cancellations, accuracy of third-party information, or damages arising from event attendance.

Section 18

Rules for Adding Concerts

ProMusica is a platform designed for the professional presentation of musicians, organizers, orchestras, and festivals in the field of classical music. The following rules apply to all users who add concerts — whether musicians, orchestras, festivals, or organizers.

18.1 General Obligations

When creating a concert, you agree to:

  • provide accurate and current information about the concert (title, date, venue, performers),
  • update or delete the concert in case of changes or cancellation,
  • not create false, duplicate, or test events,
  • not impersonate another person, ensemble, or organization.

18.2 Permitted Concerts

Only the following types of concerts may be published on ProMusica:

  • classical and art music concerts (symphonic, chamber, solo, opera, choral, etc.),
  • concerts by professional musicians, orchestras, ensembles, and festivals,
  • concerts by conservatory and university-level music students.

18.3 Prohibited Concerts

The following are prohibited on the platform:

  • concerts and showcases of elementary art schools, including performances by their students and teachers,
  • school recitals, assemblies, and internal performances of educational institutions (except conservatories and universities),
  • pop, rock, jazz, folk, and other non-classical music concerts,
  • commercial advertising, promotional events, or events unrelated to concert activity,
  • test, duplicate, or fictitious concerts.

18.4 Concert Photo Requirements

The concert thumbnail image must be:

  • a quality photograph of the performers, concert hall, or an artistic photo related to the concert,
  • a minimum resolution of 1920 x 1080 px.

It is prohibited to use as a thumbnail:

  • posters, flyers, and graphics with text,
  • screenshots, collages, or low-quality images,
  • images unrelated to the concert or classical music.

18.5 Consequences of Violation

Warning: Concerts that do not comply with the above rules may be removed without prior notice. Repeated violations may result in a temporary or permanent ban on adding concerts, or account suspension.

Section 19

Payment Terms

The service is currently free of charge. We will inform you about any future paid features.

Section 20

Limitation of Liability

The App is provided "as is". We do not guarantee uninterrupted or error-free operation.

Section 21

Termination and Suspension

You can delete your account in the App: Settings → Delete Account. Personal data will be removed within 30 days.

We reserve the right to suspend access for violation of these Terms.

Section 22

Changes to Terms

We will notify you of significant changes in the App. By continuing to use the App, you agree to the updated Terms.

Governing Law

These Terms are governed by the laws of the Czech Republic.
